The Declaration of Restrictions
for Spice Bay (the “Declaration”) requires all plans
and specifications for construction of homes and other improvements
within the Spice Bay subdivision to be submitted to, and approved
by, Victoria Bay, Inc., a Florida corporation (the “Developer”).
As authorized by Article 10 of the Declaration, the Developer has
adopted certain restrictions and regulations governing construction
of homes and other improvements within the Spice Bay subdivision.
These restrictions and regulations, referred to as the “Architectural
Criteria,” are supplemental to the requirements and provisions
of Article 10 of the Declaration.
The Architectural Criteria adopted by the Developer
are as follows:
PLANS
All plans submitted to the Developer for approval
shall include the following
items to the extent applicable:
1. Landscaping Plan. At least 70 percent of the new plants (excluding dune plants)
shown on the Landscaping Plan shall be larger than a 1-gallon container size.
2. Exterior Lighting Plan.
3. Irrigation Plan.
4. Drainage Plan. Gutters and downspouts are required for homes. Surface stormwater
shall be directed to catch basins. Downspouts and catch basins shall be connected
by underground pipes to the drainage system presently in place on each Building
Site.
5. Detailed drawing for mailbox and street numbers.
6. Three full sets of signed and sealed architectural plans and specifications
as submitted to governmental agencies for permitting.
ADDITIONAL SUBMISSIONS
The following items, to the extent applicable,
shall also be submitted to the Developer connection with any application
for approval:
1. Specifications for all exterior products, including exterior colors and materials
and including manufacturer and grade for windows and doors.
2. Manufacturers’ warranties on all exterior products.
3. Proof of builder’s risk, general liability, and workers’ compensation
insurance.
4. Copies of all permits.
5. Copy of recorded notice of commencement.
6. Engineer’s certification for compliance with all governmental wind load
requirements.
7. Construction schedule.
CONSTRUCTION SPECIFICATIONS
1. Only auger cast piles may be used. No driven
piles are permitted.
2. Elastomeric paint with a minimum 10-year warranty
shall be used for exterior painted surfaces. All exterior metal
elements shall be copper, bronze, anodized
aluminum, epoxy painted aluminum, or baked enamel on aluminum.
3. One waterproof electrical outlet on each side of a home is required on the
ground level for maintenance equipment.
4. At least three hosebibs, reasonably spaced, are required on the ground level
of a home.
5. Stucco finishes shall have expansion joints appropriate to the structure.
Expansion joints shall be shown on the submitted plans.
CONSTRUCTION SITE
1. During construction, the general contractor
shall provide a water meter and
temporary electric power on site.
2. During construction, the general contractor shall install and maintain a silk
screen fence across the rear of the construction site and along each side line
of the building site adjoining a completed home or home under construction.
3. During construction, the general contractor shall provide a portable toilet
facility on the construction site. The facility shall be screened in an attractive
manner. The location and screening of the facility shall be as approved by the
Developer.
ACCESS
Spice Bay Homeowners Association, Inc. (the “Association”), shall
be provided access to all irrigation timers and all other equipment that may
require emergency shut-off.
FEES AND CHARGES
1. Each application submitted to the Developer
for approval shall be accompanied by a $200 application
fee payable to the Association. In addition
to the application fee, the owner making application to the Developer
shall reimburse the Association for all reasonable
costs associated with the Developer’s
review of the owner’s plans, including any expense for architectural,
engineering, or attorneys’ fees.
2. Each construction site shall be kept reasonably free of trash
and debris. Excessive trash or debris on a construction site, or
trash or debris generated from the construction site and deposited
elsewhere in the
subdivision, may be removed by the Association. The Association shall
be reimbursed for the cost of such removal by the general contractor
and owner of the construction
site. The general contractor and the owner shall be jointly and severally
liable for such reimbursement.
